By accessing and placing an order with Ark DeepDefense, Inc., d/b/a ArkStreams ("ArkStreams"), you confirm that you are in agreement with and bound by the terms of service contained in the Terms of Use outlined below. These terms apply to the entire website and any email or other type of communication between you and ArkStreams.
Under no circumstances shall ArkStreams team be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if ArkStreams team or an authorized representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof.
ArkStreams will not be responsible for any outcome that may occur during the course of usage of our resources. We reserve the rights to change prices and revise the resources usage policy in any moment.
ArkStreams grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the app strictly in accordance with the terms of this Agreement.
These Terms of Use are a contract between you and ArkStreams (referred to in these Terms of Use as "ArkStreams", "us", "we" or "our"), the provider of the ArkStreams website and the services accessible from the ArkStreams website (which are collectively referred to in these Terms of Use as the "ArkStreams Service").
You are agreeing to be bound by these Terms of Use. If you do not agree to these Terms of Use, please do not use the ArkStreams Service. In these Terms of Use, "you" refers both to you as an individual and to the entity you represent. If you violate any of these Terms of Use, we reserve the right to cancel your account or block access to your account without notice.

ArkStreams maintains a zero-tolerance policy for content or behavior that is violent, abusive, hateful, sexually explicit, or otherwise objectionable.
By using the Service, you agree:
ArkStreams uses automated and human moderation to help identify policy-violating content in photo and video feeds. Filtered or stylized versions of your UGC may appear in other users' feeds with decorative or musical overlays as part of ArkStreams' curation and presentation. We aim to review valid reports promptly but do not guarantee any response time. While AI-powered filtering assists in content moderation, users are ultimately responsible for what they post and share.
You retain ownership of your UGC. By uploading or posting UGC, you grant ArkStreams a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt, publish, translate, create derivative works from, publicly perform, publicly display, distribute, and otherwise use your UGC solely to operate, improve, promote, and provide the Service. This includes (a) formatting, transcoding, resizing/cropping, re-framing, and applying aesthetic elements such as Olive Branch Frames and classical music adornments; (b) generating thumbnails, previews, and indexes; and (c) displaying your UGC (and excerpts) for in-product promotion and discovery features.
This license ends when you remove your UGC from the Service or delete your account, except (i) where your UGC has been shared, saved, or re-used by other users under Service functionality; (ii) for a commercially reasonable period needed for routine backups, archives, and logs; and (iii) for any copies retained to comply with legal obligations.
You represent and warrant that you own or have all necessary rights to your UGC (including music, images, and the names and likenesses of any identifiable persons) and that your UGC does not infringe or violate any third-party rights or laws (including privacy and publicity).
ArkStreams may display external content in the Info Hub, including news headlines, articles, and links from third-party sources obtained through publicly available RSS feeds and other content aggregation methods. This external content is provided for informational purposes only.
ArkStreams does not own, create, or endorse external content displayed in the Info Hub. External content is owned by and remains the property of the respective third-party publishers and content providers. We make no representations or warranties regarding the accuracy, completeness, timeliness, or reliability of any external content.
Links to external websites or articles are provided for convenience only. ArkStreams is not responsible for the availability, content, privacy practices, or terms of use of external websites. Your use of external websites is at your own risk and subject to those websites' terms and policies.
You may control the volume of external news content displayed through your filter settings (Small, Moderate, or Large volume levels). These settings determine how frequently external content appears in your Info Hub feed.
ArkStreams uses automated systems to aggregate and display external content based on your preferences and filter settings. We do not exercise editorial control over the selection or presentation of specific external articles beyond basic categorization and volume controls. External content may reflect views, opinions, or information that ArkStreams does not endorse or verify.
External content may be removed, become unavailable, or change at any time without notice. ArkStreams reserves the right to modify or discontinue the display of external content sources at its sole discretion.

If your UGC includes any person's name, image, voice, or likeness, you must obtain all permissions required by law. You may not upload images of minors without verifiable parental consent where required.
ArkStreams uses automated systems and human review to help identify content that may violate these Terms of Use or Community Standards. These systems have inherent limitations and may fail to identify or may incorrectly flag content. You may still encounter content you consider offensive or objectionable.
You can report content via in-app tools. ArkStreams may remove or restrict content, disable features, or suspend/terminate accounts at our sole discretion. We aim to review valid reports promptly but do not guarantee any response time. ArkStreams is not obligated to remove any specific content.

As with any shopping experience, there are terms and conditions that apply to transactions at ArkStreams. We'll be as brief as our attorneys will allow. The main thing to remember is that by placing an order or making a purchase at ArkStreams, you agree to the terms along with ArkStreams's Privacy Policy.
If, for any reason, you are not completely satisfied with any good or service that we provide, don't hesitate to contact us and we will discuss any of the issues you are going through with our product.
Paid subscriptions automatically renew each billing period until canceled. If a free trial is offered, you will be charged at the end of the trial unless you cancel before the trial ends.
Billing: We bill through a third-party processor or platform (e.g., App Store). Taxes may apply.
Cancellation: You can cancel at any time via your account settings or the platform where you purchased (e.g., Apple App Store subscriptions). Cancellation takes effect at the end of your current billing period; access continues until then. Payments are non-refundable except where required by law.
Price/Changes: We may change prices or terms prospectively with notice as required by law. If you do not agree to changes, cancel before they take effect.
California Auto-Renewal: For California residents, we provide clear disclosure of auto-renewal terms before purchase, obtain your affirmative consent, and provide a simple online cancellation method.
ArkStreams terminates, in appropriate circumstances, users who are repeat infringers. Notices under 17 U.S.C. §512 should be sent to:

Your notice must include the elements required by 17 U.S.C. §512(c)(3): (a) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing and where it is located on the Service; (d) your contact information, including your address, telephone number, and email; (e) a statement that you have a good faith belief that use of the material is not authorized by the copyright owner; and (f) a statement that the information in the notification is accurate, and, under penalty of perjury, you are authorized to act on behalf of the owner. Counter-notices should follow 17 U.S.C. §512(g).
The app and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by ArkStreams, its licensors or other providers of such material and are protected by USA and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of ArkStreams, unless and except as is expressly provided in these Terms of Use. Any unauthorized use of the material is prohibited.
Nothing in this section transfers ownership of your UGC to ArkStreams. Our license to your UGC is limited to the purposes and scope described under "User-Generated Content and Feeds."
This section applies to any dispute EXCEPT IT DOESN'T INCLUDE A DISPUTE RELATING TO CLAIMS FOR INJUNCTIVE OR EQUITABLE RELIEF REGARDING THE ENFORCEMENT OR VALIDITY OF YOUR OR ArkStreams's INTELLECTUAL PROPERTY RIGHTS. The term "dispute" means any dispute, action, or other controversy between you and ArkStreams concerning the Services or this agreement, whether in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. "Dispute" will be given the broadest possible meaning allowable under law.
In the event of a dispute, you or ArkStreams must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via email to: hello@arkdeep.com. ArkStreams will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address. You and ArkStreams will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. After sixty (60) days, you or ArkStreams may commence arbitration.
If you and ArkStreams don't resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted exclusively by binding arbitration as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. The dispute shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Either party may seek any interim or preliminary injunctive relief from any court of competent jurisdiction, as necessary to protect the party's rights or property pending the completion of arbitration. Any and all legal, accounting, and other costs, fees, and expenses incurred by the prevailing party shall be borne by the non-prevailing party.
Seat, Rules, and Venue: Arbitration will be conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The seat and venue will be Santa Clara County, California, unless the AAA rules or applicable law require otherwise.
You and ArkStreams agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
The arbitrator may not consolidate claims or preside over any representative or class proceeding.
Either party may bring qualifying claims in small-claims court in Santa Clara County, California (or your county of residence in the U.S.) instead of arbitration. You may opt out of arbitration by sending a written notice to hello@arkdeep.com within 30 days after you first accept these Terms of Use; your opt-out will not affect prior agreements to arbitrate.
The app is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, ArkStreams, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the app, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.
Specifically, ArkStreams makes no warranty that:
Notwithstanding any damages that you might incur, the entire liability of ArkStreams and any of its suppliers under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the app.
